Auction conditions of Rue Pinard B.V.
1. General Terms and Conditions These auction conditions apply to all auctions organised by Rue Pinard B.V. via the platform RuePinard.auction. By participating in an auction, bidders and sellers agree to these terms and conditions. The terms cover all aspects of participation, bidding, payments, shipping, and dispute resolution.
2. Conditions of participation
- Participants must be at least 18 years old.
- Buyers and sellers must comply with all applicable local and international laws regarding the sale and shipment of alcoholic beverages.
- Before a participant can place a bid, they must register and have their identity verified.
- Rue Pinard reserves the right to refuse registration or suspend an account if there is any doubt about the reliability of a participant.
3. Role of Rue Pinard and Salesman
- Rue Pinard acts as an auction platform and intermediary, but in some cases it can also act as a seller.
- Sellers are responsible for the conformity, authenticity and legality of the lots offered.
- Rue Pinard offers an Authenticity Guarantee. If a lot is identified as a counterfeit, the transaction will be cancelled and the buyer will receive a full refund.
- Rue Pinard has the right to remove lots from the auction if they do not comply with the guidelines or if there is any doubt about the authenticity.
4. Merchant Terms of Acceptance
- Rue Pinard only accepts original bottles in unopened and sealed condition.
- Wine and spirits have specific requirements regarding fill height, label condition and packaging.
- Only products from reputable producers and regions with a minimum value of €75 per lot are accepted.
- Old wines and spirits must have been demonstrably well preserved.
- Packaging such as original wooden boxes and special gift boxes are appreciated and can increase the resale value.
- Not allowed lots: empty bottles, damaged packaging, non-original seals or bottles without complete origin information.
5. Bidding and Payment
- All bids are binding and cannot be withdrawn.
- Bidders can set automatic bids through the auction platform, with the system bidding on their behalf up to a maximum set limit.
- Buyers must pay the purchase price, including an 18% buyer's commission and any taxes and shipping charges, within five (5) business days after the auction ends.
- Payments must be made through the payment methods designated by Rue Pinard and come from a bank account in the name of the buyer.
- If a buyer fails to pay on time, Rue Pinard may charge interest and collection fees or take legal action.
6. Buyer's Commission and Seller's Commission
- Buyers pay an 18% commission on the final hammer price.
- Sellers pay a commission of 15% on the sale price (excluding VAT).
- Additional fees may apply to certain payment methods or currency conversion transactions.
7. Minimum amount and reserve price
- Each lot can have a minimum amount. This minimum amount may not exceed the lowest estimate.
- Rue Pinard can change the minimum amount on behalf of the seller if necessary.
- If a lot is not sold, it can be offered in a post-auction sale under the same conditions.
- In the event of repeated failed auctions, Rue Pinard may advise the seller to set a lower reserve price or remove the item from the auction.
8. Obligations of the Buyer
- The buyer is responsible for import duties and customs fees.
- Upon receipt, the buyer must report any defects or disputes within 48 hours.
- If the buyer does not pay on time, Rue Pinard reserves the right to withdraw the offer, impose interest and take legal action.
- Buyers may be required to undergo financial verifications in advance before they are allowed to bid on certain lots.
9. Bidding steps The following bidding steps are used on the Rue Pinard auction platform:
- €1 - €100: increase of €5
- €100 - €500: increase of €10
- €500 - €1,000: increase of €25
- €1,000 - €5,000: increase of €50
- €5,000 - €10,000: increase of €100
- €10,000 - €50,000: increase of €250
- €50,000 - €100,000: increase of €500
- €100,000 - €500,000: increase of €1,000
- €500,000 and above: increase of €2,500
10. Addendum: Terms of Acceptance by Beverage Category
10.1 Wine & Champagne
- Only wines with a minimum market value of €15 per bottle are accepted.
- Vintage champagne is only accepted from 2000 or earlier.
- The condition of the label, the filling height and the capsule must be good.
10.2 Whisky
- Only bottles from reputable distilleries are accepted.
- Minimum value per bottle: €30.
- Broken or missing seals are not permitted.
10.3 Cognac, Rum & Other Spirits
- Cognac and Armagnac must have at least XO quality.
- Rum must come from well-known distilleries and must not be artificially sweetened.
- Bottles must be intact and properly preserved.
10.4 Port, Sherry & Madeira
- Only premium Port, Sherry and Madeira are accepted.
- Minimum aging: 10 years for Tawny, Colheita or Vintage.
10.5 Collectibles & Accessories
- Only collectibles from premium brands, such as sabres, decanters and original wooden boxes, are accepted.
- Empty bottles, loose corks and generic accessories without collector's value will not be accepted.
